Real Estate and Mortgages

Family Law (Separation & Divorce)

Each of Messrs. Scaddan and Jakob have over 25 years experience in matrimonial law, dealing with issues involving marriage break-ups, whether through negotiated Separation Agreements, or through litigation in the form of divorce proceedings. This includes resolving the often very emotional and exasperating issues related to children, custody and access, support, division of property, etc.. Wills, Estates, Powers of Attorney

It is extremely important to ensure that your affairs are in order if you are ever injured, incapacitated or even pass, whether from injury or accident. Every person of majority age should have both a Last Will and Testament, and a Power of Attorney. This will ensure that your estate and the property you have worked so hard to acquire, finds it's way into the hands of your beneficiaries. A Will also allows you to appoint persons to administer your estate as well as to appoint guardians to take care of any minor children. A Power of Attorney allows you to appoint someone to make decisions on your behalf should you became incapacitated, whether through age or illness. That person, referred to as your "attorney" can also make health care related decisions for you. A power of attorney is terminated upon death, at which time your Will becomes effective. Accordingly the two documents go hand-in-hand. Scaddan and Jakob also can assist Estate Trustees in "administering" estates, whether through the probate process, or without the necessity of probating a Will. More importantly, we can assist with your Estate Planning at the time of discussing your Will, to find ways to avoid the probate process and paying substantial tax which could save the estate and the beneficiaries thousands of dollars.

Litigation

Scaddan & Jakob can also assist clients with commencing or defending lawsuits. Whether you wish to sue someone over an injury, or for the collection of debt, or correspondingly, to defend an action brought against you, we can help. Scaddan and Jakob also works closely with litigation counsel to refer "specialized" litigation to the appropriate lawyer who may work solely in that area of practice.
